Side hustle tax: when does your hobby become a business?

Selling prints on Etsy, flipping furniture, a bit of freelance work after hours — at some point the tax question arrives: is this a hobby, or a business the ATO expects a cut of? Here's where the line actually sits, and what to do on each side of it.

First, kill the myth

There is no magic dollar figure below which side income is tax-free. People quote "$5,000" or "under $18,200 doesn't count" — neither is how it works. If what you're doing is a business, its income is taxable from the first dollar (the $18,200 tax-free threshold applies to your total income from everywhere, and a salary usually eats it already). If it's genuinely a hobby, the money isn't taxed — but you also can't claim any losses or deductions.

So everything turns on one question: hobby or business? The ATO decides on the pattern of what you do, not on the amount.

Where the ATO draws the line

No single factor decides it — it's the overall picture. You're drifting from hobby into business territory the more of these are true:

  • You intend to make a profit

    You price to make money, not just to cover materials for something you'd do anyway.

  • It's repeated and organised

    Regular sales, an online store, a booking system, advertising — activity with rhythm, not one-offs.

  • You operate in a business-like way

    Records, a separate bank account, branding, quotes and invoices, stock on hand.

  • It's growing

    Scale, reinvestment, and time committed look like building something, not pastime spending.

If it's a business: what you actually owe

The good news: it's simpler than people fear. Your side-hustle profit (income minus expenses) is added to your salary and taxed at your marginal rate through your normal tax return — as a sole trader you don't need a company or a separate return. You'll want an ABN (free), and from there three things matter:

  • Declare the income, claim the costs

    Materials, platform fees, packaging, a share of phone and internet, home-office running costs, depreciation on gear — real deductions people routinely leave on the table.

  • The $75k GST trap

    Cross $75,000 turnover (not profit) in a rolling 12 months and GST registration stops being optional. Miss it and the ATO can treat 1/11th of your sales as GST you owed anyway — from your own pocket.

  • Put a slice aside

    No employer is withholding for you. Park 25–35% of profit in a separate account and the eventual bill (and later, PAYG instalments) is a non-event instead of a crisis.

There's no dollar threshold. Genuine hobby income isn't taxed at any amount, and business income is taxed from the first dollar — what matters is whether the activity is a business: profit intention, repetition, and business-like organisation. The ATO looks at the pattern, not the number.
